The teenager who was behind the wheel in the June single-car accident that claimed the life of her passenger, 18-year-old Jena Pothier of Oak Bluffs, was arraigned Tuesday morning in Edgartown district court.

Kelly McCarron, 18, was arraigned on three counts of motor vehicle homicide, two counts of negligent operation and five counts of operating under the influence of alcohol, all criminal charges.

She also faces civil violations, including failure to wear a seat belt and defective equipment. Ms. McCarron, who was thrown from the car and seriously injured in the accident and spent several weeks recovering in Boston area hospital, was surrounded by family members during the arraignment. When her name was called, she remained silent while a plea of not guilty was entered on her behalf on all charges.

At the request of defense attorney Charles A. Morano, the reading of the charges was waived. Also at the request of her attorney and by consent of the Cape and Islands district attorney, Ms. McCarron was released on personal recognizance. The Hon. Lance Garth, an associate justice of the district court, ordered Ms. McCarron to not use alcohol; she will be subjected to random alcohol testing.

A pre-trial conference is set for Oct. 16.

The June 11 one-car accident took place at about 10 p.m. on the Edgartown-West Tisbury Road approximately one mile from the entrance to the Martha’s Vineyard Airport. Speed and alcohol were both factors.

Ms. McCarron and the late Ms. Pothier were friends. Ms. Pothier had graduated from the Martha’s Vineyard Regional High School last year and was attending Plymouth State College. Ms. McCarron graduated from the regional high school three days after the accident; because she was in hospital, her mother and sister accepted her diploma.

The incident report from the West Tisbury police department was made public this week following the arraignment. The accident remains under investigation.
