Following cases heard in Edgartown district court.
Clay R. Merrill, 55, of Edgartown, admitted to sufficient facts in June 2011 assault with a dangerous weapon charge, continued without a finding for one year. Ordered to pay $90 victim witness assessment, $65 monthly probation services fee, serve 24 hours community service. Two charges of threat to commit a crime and malicious destruction of property more than $250 dismissed at request of commonwealth.
Christopher S. Francis, 37, of Vineyard Haven, arraigned on Jan. 8 assault and battery charge in Vineyard Haven. Pretrial hearing on Feb. 6.
Steven Devito, 46, of Oak Bluffs arraigned on Jan. 8 charge in Oak Bluffs of assault and battery, unlawful wiretapping, allegedly assaulting his roommate, unlawfully concealing a recording device. Pretrial hearing on Jan. 20.
Scott A. Chase, 21, of Vineyard Haven, pleaded guilty to Oct. 23 charge in Tisbury of negligent operation of motor vehicle. Probation for a year, ordered to pay $300 in fees, $50 monthly probation services fee and complete 24 hours community service. Found not responsible for Oct. 23 charges of failure to stop/yield and possessing an open container of alcohol in a motor vehicle. Charge of drunken driving dismissed at request of commonwealth.
Joseph F. Wardell 3rd, 49, of Oak Bluffs, arraigned on Oct. 1 charges in Edgartown of drunken driving, negligent operation of motor vehicle, marked lanes violation. Not-guilty plea entered, pretrial hearing on Feb. 23.
Robert Streed, 44, of Amherst, N.H., had an Oct. 1 charge of assault and battery in Vineyard Haven dismissed at request of victim.
Drew Moreis, 18, of Vineyard Haven, placed on pretrial probation for one year for August 20 charge of assault and battery, ordered not to abuse alleged victim.
Daniel A. Ben David, 49, of Oak Bluffs, pleaded guilty to Nov. 11 charges of assault and battery (amended from assault and battery with a dangerous weapon) and disorderly conduct in Oak Bluffs, placed on probation for one year. Ordered to pay a $50 victim witness assessment, $50 monthly probation services fee, stay away from victim and Seasons Pub. Charge of affray dismissed at request of commonwealth.
Michael E. Almeida, Jr., 31, of Fairhaven, pleaded guilty to assault and battery on Jan. 2 in Oak Bluffs, sentenced to two and a half years in Dukes County house of correction with six months to serve and balance suspended for two years, 12 days of jail credit given. Ordered to pay $50 victim witness assessment, $65 monthly probation services fee. Jan. 3 charge of violating an abuse prevention order dismissed at request of commonwealth.
Anthony A. Foster, 41, of Edgartown arraigned for unarmed and assault burglary, breaking and entering building during the night for felony, assault to murder (strangulation), assault and battery on Jan. 12 in Aquinnah. Released on $1,000 cash bail, ordered not to contact or abuse alleged victim, an Aquinnah woman. Pretrial hearing on Feb. 6.
