A Falmouth-based fuel company was fined $25,000 and sentenced to three years probation in Dukes County superior court this week for charges related to an Oak Bluffs oil spill.

Loud Fuel Co. of Falmouth, and its manager, Kabraul Tasha of Pocasset, pleaded guilty on Monday to one count each of failing to report an oil spill and environmental endangerment. The charges stem from a June 19, 2009 incident in which Mr. Tasha failed to properly connect gas transfer hoses at Jim’s Package Store during a fuel delivery, causing an estimated 50 gallons of gasoline to spill into an alley between the Lake street package store and Nancy’s Restaurant.

According to a statement issued by the attorney general’s office on Thursday, Mr. Tasha made efforts to clean up the gasoline with absorbent pads in his truck, but failed to notify the Massachusetts Department of Environmental Protection and initially denied knowledge of the incident. Authorities were alerted to the spill when workers at Nancy’s Restaurant reported a strong gasoline order. Upon inspection, they found “imminent hazard levels in the restaurant’s first floor.”

In addition to the fines and probation, the Hon. Cornelius Moriarty 2nd ordered Loud Fuel Co. to train its employees annually in spill prevention and reporting, pay for and conduct annual environmental audits, and pay unreimbursed costs to Nancy’s Restaurant. Mr. Tasha was ordered to pay a $3,000 fine and attend annual training in spill prevention and reporting.

“These defendants failed to immediately report a release of gasoline, causing damage to nearby businesses and also putting customers and employees at risk of a dangerous explosion,” said Attorney General Martha Coakley.

The fuel company previously agreed to hire a professional to clean Nancy’s Restaurant. The case has been continued without a finding for two years.
