An Oak Bluffs man charged with injuring his infant daughter was sentenced Tuesday to at least three years in state prison.

Shaun A. Sicsico, 20, pleaded guilty Tuesday morning in Dukes County superior court on a charge of assault and battery on a child with substantial injury. The Hon. Tina S. Page, associate justice of the superior court, sentenced Mr. Sicsico to three to five years at MCI Cedar Junction, a maximum security facility in Walpole.

Mr. Sicsico will not be prosecuted on a charge of permitting substantial injury to a child, superior court officials said. The commonwealth filed a new complaint of assault and battery, and Mr. Sicsico waived indictment and was found guilty and sentenced to 10 years of probation after he is released from prison on the first charge, and to a $65 monthly probation services fee.

He was also ordered to submit a DNA sample and to pay a $90 victim/witness assessment fee. He was given credit for time already served in jail.

Mr. Sicsico was indicted by a grand jury in October on charges that he allegedly injured his infant daughter. According to police, his 12-week-old daughter was airlifted to a Boston hospital on July 27 with severe brain injuries. Physicians advised at the time that the injuries were consistent with abuse, police said.

The Cape and Islands assistant district attorney who prosecuted the case said the sentencing followed the state's recommendation.

"We arrived at the recommendation after carefully considering the injuries to the victim," assistant district attorney Lisa Edmonds told the Gazette. "We did it in consultation with the grandfather who is now the caregiver [of the victim]."
