WATERWAYS REGULATION PROGRAM Notice of License Application Pursuant to M. G. L. Chapter 91 Waterways License

Public notice is hereby given of the waterways application by Edgartown Yacht Club to reconstruct and maintain a pile held pier and buildings, construct a pier extension, relocate a float and maintain a Private Recreational Boating Facility pursuant to 310 CMR 9.02 at 1 Dock Street, in the municipality of Edgartown, in and over flowed tidelands of Edgartown Harbor. The proposed project has been determined to be water-dependent. The Department will consider all written comments on this Waterways application received by within 30 days subsequent to the "Notification Date". Failure of any aggrieved person or group of ten citizens or more, with at least five of the 10 residents residing in the municipality(s) in which the license or permitted activity is located, to submit written comments to the Waterways Regulation Program by the Public Comments Deadline will result in the waiver of any right to an adjudicatory hearing in accordance with 310 CMR 9.13(4)(c). The Edgartown Planning Board will hold a continuation of deliberations on Tuesday, May 1, 2018 at 6:00PM in the Edgartown Town Hall on the application of Anderson & Kreiger et al. on behalf of New Cingular Wireless PCS, LLC (AT&T) for a special permit to construct, operate, license and maintain a Personal Wireless Service Facility (“PWSF”) on “Property” located at 14 Sampson Avenue, Edgartown, Massachusetts, owned by MVWIFI, LLC. The proposed site is located on a non-conforming lot within the R-120 Zoning District, on assessors’ parcel 34-197. The proposed PWSF includes without limitation a 115-foot monopole with antennas and associated radio communications equipment is a permanent solution to address a significant gap in the wireless network coverage in the Chappaquiddick area of Edgartown. The continuation is held in accordance with MGL Ch. 40A Section 9 and the Edgartown zoning bylaw under articles 11.6.; 11.9.e.; 17.5. and 23.3. The Edgartown Planning Board will hold a public hearing on Tuesday, May 1, 2018 at 6:00PM in Edgartown Town Hall – 2nd Floor, on the application of Christina S Marshall, Anderson & Kreiger LLP, on behalf of New Cingular Wireless LLC (AT&T), requesting a modification to the special permit to amend Condition No. 1 to allow the operation and maintenance of its existing temporary 104 foot ballast mounted concealed antenna monopole and wireless communications facility until the later of (a) May 2, 2019, or (b) the date that is six months after the entry of final judgment or final settlement of any and all appeals of decisions by the Planning Board and the MV Commission. The requested modification will permit the applicant to continue to provide personal wireless service to Chappaquiddick during the time required to obtain approvals for a proposed permanent facility.
