Nov. 16

Rachel McMullen, 31, of Aquinnah, was arraigned on Nov. 13 charges in Chilmark of drunken driving, two counts of child endangerment while operating under the influence, negligent operation of a motor vehicle, marked lanes violation, possessing an open container of alcohol in a motor vehicle, child under eight years /58 inches without a carseat and speeding. According to a police report filed in court, charges stem from accident in which a motor vehicle hit a telephone pole in Chilmark, with two children under 10 allegedly in the car and sustaining injuries in the crash. Conditions of pretrial release include remaining alcohol free with screens and no driving with anyone under 16 years old in the car. A pretrial hearing was scheduled for Dec. 3.

Nov. 20

James L. Harper, 68, of Edgartown, was arraigned on Nov. 20 charges in Edgartown of assault and battery on a family/household member and threat to commit a crime. A pretrial hearing was scheduled for Dec. 10.

Raymond C. Stemmle, 54, of Edgartown, had April 22 charges in Edgartown of assault and battery on a family/household member and breaking and entering a building in the nighttime for a felony dismissed upon request of the commonwealth, request of the alleged victim.

Nov. 23

Daniel J. Adams, 38, of Vineyard Haven, was found not guilty in a bench trial by Judge Thomas Kirkman on a July 1, 2013 charge in Vineyard Haven of larceny more than $250 by false pretense.

Timothy Amaral, 46, of Oak Bluffs, had a July 13 charge in Oak Bluffs of employer willfully failing to pay timely wages dismissed upon request of the commonwealth, restitution of $1,000 having been paid to the alleged victim.

Joao F. Araujo, 51, of Vineyard Haven, admitted to sufficient facts on an Oct. 4 charge in Oak Bluffs of negligent operation of a motor vehicle, continued without a finding for one year and ordered to pay $500 in fines. A charge of drunken driving was dismissed upon request of the commonwealth and found not responsible on charge of marked lanes violation.

Donald H. Clarke, 63, of Edgartown, was placed on one year of pretrial probation on an August 16 charge in Oak Bluffs of negligent operation of a motor vehicle. Found not responsible on charge of marked lanes violation.

Nyssa T. Duarte, 18, of Oak Bluffs, was arraigned on an Oct. 10 charge in West Tisbury of assault and battery. A pretrial hearing was scheduled for Dec. 21. In a separate case, Sept. 5 charge in Oak Bluffs of assault and battery on a family/household member was dismissed upon request of the commonwealth.

Myles C. Goodwin, 23, of Oak Bluffs, was arraigned on Nov. 21 charges in Oak Bluffs of drunken driving, negligent operation of a motor vehicle, and marked lanes violation. Pretrial hearing scheduled for Dec. 10.

Oliver Lane, 19, of Edgartown, will have a July 30 charge in Edgartown of negligent operation of a motor vehicle dismissed if 20 hours of community service are completed by Feb. 24. Charges of number plate violation to conceal identity and uninsured motor vehicle dismissed upon request of the commonwealth and found not responsible on charge of unregistered motor vehicle.

Brandie M. Lewis, 40, of Vineyard Haven, was arraigned on Nov. 22 charge in Vineyard Haven of assault and battery on a family/household member. A pretrial hearing was scheduled for Dec. 21.

Stephen W. Luce, 44, of Edgartown, was arraigned on Sept. 23 charges of negligent/reckless operation of recreational vehicle, refusing to stop for police on recreational vehicle, unregistered recreational vehicle, public way violation on recreational vehicle, and helmet violation on recreational vehicle. According to a police report, he allegedly operated a four-wheel ATV on Norton Point Beach, and then on Katama Road at a high rate of speed. A pretrial hearing was scheduled for Dec. 31.

Robert J. Lusher Jr., 46, of Vineyard Haven, pleaded guilty on Sept. 30 charge in Vineyard Haven of drunken driving, amended from drunken driving, second offense. Placed on probation for one year, ordered to pay $600 in fees and $65 monthly probation services fee, to complete 24-day driver alcohol education program and to lose license for 45 days and undergo 24Q evaluation. Charge of negligent operation of a motor vehicle was dismissed upon request of the commonwealth and found not responsible on charge of marked lanes violation.

Gilberto Quintanal Jr., 44, of Vineyard Haven, had March 21 and May 23 charges in Vineyard Haven of sex offender fail to register dismissed, motion to dismiss allowed.

Karen Singer, 66, of West Tisbury, admitted to sufficient facts on a Feb. 1 charge in Vineyard Haven of larceny more than $250 by single scheme, continued without a finding for two years. Ordered to be evaluated by the office of community corrections and to engage in any program/treatment as mandated, defendant may re-address issue on January 29 if needed. Ordered to pay $90 victim/witness assessment fee and $65 monthly probation services fee. Alleged to have taken merchandise while an employee at Midnight Farm in Vineyard Haven. Feb. 1 charges of shoplifting more than $100 by asportation and larceny more than $250, April 7 charge of false creation or use of a sales receipt and Oct. 21 charge of possessing a class E drug (Xanax) were dismissed upon request of the commonwealth.

Cooper S. Warden, 20, of Johnson, Vt., admitted to sufficient facts on a July 4 charge in Edgartown of negligent operation of a motor vehicle, continued without a finding for one year. Ordered to complete 20 hours of community service at non-profit approved by probation and to pay $300 in fees and a $50 monthly probation services fee. A charge of drunken driving was dismissed upon request of the commonwealth.

Nov. 30

Kenneth P. Davey, 56, of Oak Bluffs, had June 26, 1986 charge of drunken driving dismissed upon request of the commonwealth and found not responsible on charges of marked lanes violation and speeding after motion for a new trial was allowed and previous disposition vacated.

Kenneth A. Davey, 56, of Oak Bluffs, pleaded guilty on March 22 charge in Oak Bluffs of drunken driving, amended from drunken driving, third offense. Placed on probation for two years, ordered to complete a 24-day driver alcohol education program and to lose license for 45 days, and to pay $600 in fees. Admitted to sufficient facts on possessing a class C drug (Valium), continued without a finding for two years.

Michelle L. Filkins, 44, of Edgartown, had April 17 charges in Edgartown of breaking and entering a building in the nighttime for a felony, larceny more than $250, and malicious destruction of property more than $250 dismissed upon lack of criminal responsibility as determined by the department of mental health.

Christopher Lowe, 40, of West Tisbury, was arraigned on Nov. 23 charges in Oak Bluffs of drunken driving, disorderly conduct, and resisting arrest. A pretrial hearing was scheduled for Dec. 10.

Barbara A. McCarron, 54, of Edgartown, had Sept. 15 and Oct. 12 charges in Edgartown of violating a harassment prevention order dismissed without prejudice.

William P. Munson, 31, of Oak Bluffs, pleaded guilty on Oct. 6 charge in Vineyard Haven of drunken driving and negligent operation of a motor vehicle, placed on probation for two years. Ordered to pay $850 in fees and $65 monthly probation services fee, to complete 24-day driver alcohol education fee, and to lose license for 45 days. Charge of child endangerment while OUI was dismissed upon request of the commonwealth.

Talia Y. Rogers, 24, of Oak Bluffs, pleaded guilty on Nov. 12, 2014 charge in Edgartown of larceny from a building, sentenced to six months in a house of correction, suspended 18 months and placed on probation for 18 months. Ordered to remain drug free with counseling as mandated by the office of community corrections/probation, to pay $1,400 in restitution and $90 victim/witness assessment fee, probation services fee waived if paying restitution consistently. According to a police report filed in court, charge stems from theft of $1,000 from a home. Charge of breaking and entering a building in the daytime for a felony was dismissed upon request of the commonwealth.

Marcus J. Smith, 22, of Vineyard Haven, was arraigned on Nov. 26 charges in Oak Bluffs of drunken driving, negligent operation of a motor vehicle, and marked lanes violation. A pretrial hearing was scheduled for Jan. 4.

Justin Stenius, 36, of Ashburnham, pleaded guilty on Sept. 26 charges in Vineyard Haven of negligent operation of a motor vehicle and failure to stop for police, sentenced to six months in a house of correction, suspended one year and placed on probation for one year. Ordered to pay $400 in fees and a $50 monthly probation services fee. A charge of possessing a class B drug (cocaine) was dismissed upon request of the commonwealth and found not responsible on charges of marked lanes violation and trespassing with a motor vehicle. According to a police report filed in court, he allegedly failed to pull over for police and pulled into a driveway off Lambert’s Cove Road, continued along a pasture, went into the yard of a home and came to a rest on the shoreline of Tashmoo Pond.
