The following cases were heard in Edgartown district court.

April 28

Brandy Taylor, 64, of Vineyard Haven, will not be prosecuted on August 21 charge in Vineyard Haven of permitting abuse on an elder/disabled person.

May 1

Maggie E. Lindland, 23, of Edgartown, admitted to sufficient facts on April 10, 2016 charge in Oak Bluffs of negligent operation of motor vehicle, continued without finding for one year. Ordered to pay $300 in fees and $50 monthly probation services fee and to complete 20 hours of community service. Charge of drunken driving dismissed upon request of commonwealth and found not responsible on marked lanes violation and speeding in violation of special regulation.

May 4

Theodore C. Bennett, 35, of Edgartown, had Feb. 3 charge in Edgartown of operating under the influence of drugs dismissed by agreement after motion to dismiss allowed, insufficient probable cause.

Arthur M. Decastro, 22, of Edgartown, had August 24 charge of possessing a class B drug (cocaine) dismissed upon request of commonwealth, insufficient evidence to proceed/prosecute. A May 1 memo by Judge James McGovern found that any evidence derived from a motor vehicle stop should be suppressed because officers lacked probable cause and did not obtain a warrant.

Paul J. Metell, 59, of West Tisbury, arraigned on March 18 charges in Edgartown of leaving the scene of property damage, negligent operation of motor vehicle, speeding and marked lanes violation. According to police report filed in court, charge stems from alleged one-car motor vehicle crash that damaged a home on South Water street. Pretrial hearing scheduled for June 22.

Alexandra A. Nunes, 24, of Oak Bluffs, arraigned on Feb. 18 charges in Edgartown of negligent operation of motor vehicle and unlicensed operation of motor vehicle. According to police report charges stem from allegedly hitting other cars at post office parking lot. Pretrial hearing scheduled for June 1.

May 5

Princess V. Bettencourt, 30, of Edgartown, admitted to sufficient facts on July 10 charge in Oak Bluffs of negligent operation of motor vehicle, continued without finding for one year and ordered to pay $300 in fees and $50 monthly probation services fee. Charge of drunken driving dismissed upon request of commonwealth and found not responsible on marked lanes violation.

Anthony M. Cardoza, 27, of Vineyard Haven, arraigned on March 14 charge in Vineyard Haven of malicious destruction of property more than $250 (car). Pretrial hearing scheduled for June 2.

Christy L. Dobson, 26, of Vineyard Haven, admitted to sufficient facts on Jan. 9 charge in Edgartown of drunken driving, continued without a finding for one year. Ordered to pay $600 in fees and to $65 monthly probation services fee and to complete 24-day driver alcohol education fee and to lose license for 45 days. Charge of negligent operation of motor vehicle dismissed upon request of commonwealth and found not responsible on marked lanes violation.

Christina S. Farley, 30, of Boston, admitted to sufficient facts on Sept. 22, 2015 charge in Vineyard Haven of negligent operation of motor vehicle, continued without finding for one year and ordered to pay $300 in fees and $50 monthly probation services fee and to complete 20 hours of community service. Charge of drunken driving dismissed upon request of commonwealth and found not responsible on failure to stop/yield.

Colleen A. Francis, 64, of Vineyard Haven, had Oct. 5 charges in Oak Bluffs of two counts of leaving the scene of property damaged dismissed upon request of commonwealth without prejudice.

Justin M. Hershberger, 34, of Yates Center, Kan., admitted to sufficient facts on Jan. 14 charge in Oak Bluffs of assault and battery on family/household member, continued without a finding for one year and ordered to pay $50 victim/witness assessment fee and $65 monthly probation services fee, remain alcohol free and complete intimate partner abuse education program. Charge of vandalizing property dismissed upon request of commonwealth.

Andre J. Titus, 32, of Roxbury, admitted to sufficient facts on July 11, 2015 charge in Vineyard Haven of negligent operation of motor vehicle, continued without finding for one year. Ordered to pay $300 in fees and $50 monthly probation services fee and to complete 20 hours of community service Charge of drunken driving dismissed upon request of commonwealth. Found not responsible on marked lanes violation.

Christopher M. Townsend, 27, of Vineyard Haven, admitted to sufficient facts on Sept. 21 charge in Vineyard Haven of drunken driving, continued without a finding for one year. Ordered to complete 24-day driver alcohol education fee and to lose license for 45 days and to pay $600 in fees and $65 monthly probation services fee. Charge of negligent operation of motor vehicle dismissed upon request of commonwealth and found not responsible on failure to stop/yield. In a separate case, admitted to sufficient facts on Feb. 12 charge in Edgartown of negligent operation of motor vehicle, continued without finding for one year and ordered to pay $300 in fees, concurrent with other case. Charge of leaving the scene of property damage dismissed upon request of commonwealth and found not responsible on failure to stop/yield, speeding in violation of special regulation and marked lanes violation.

Dennis A. Vogel Jr., 28, of Vineyard Haven, had Oct. 12 charge in Vineyard Haven of assault and battery on family/household member dismissed upon request of commonwealth, with alleged lack of cooperation. In separate cases, guilty finding filed for six months on Feb. 7 charge in Edgartown of malicious destruction of property more than $250 and pleaded guilty on Dec. 3 charge in Edgartown of disorderly conduct, ordered to pay $150 fine. Charge of resisting arrest dismissed upon request of commonwealth.

May 8

Stephen Cianico, 34, of Vineyard Haven, had April 3 charge in West Tisbury of violating an abuse prevention order dismissed upon request of commonwealth, failure of alleged victim to cooperate.

Christopher D. Costello, 24, of Edgartown, arraigned on May 7 charges in Oak Bluffs of drunken driving, negligent operation of motor vehicle, possessing open container of alcohol in motor vehicle, and marked lanes violation. Pretrial hearing scheduled for May 22.

Mark T. Guthrie, 62, of Vineyard Haven, had June 11, 2015 charges in Vineyard Haven of drunken driving and negligent operation of motor vehicle dismissed upon request of commonwealth, insufficient evidence to proceed with prosecution. According to court documents a motion to suppress evidence was allowed. Found not responsible on possessing open container of alcohol in motor vehicle.

Jesse R. Sweeney, 33, of West Tisbury, admitted to sufficient facts on March 31 charge in Vineyard haven of possessing a class A drug (heroin), continued without finding for six months. Ordered to remain drug free and to pay $50 victim/witness assessment fee and $50 monthly probation services fee.

Jesse Thayer, 30, of Vineyard Haven, arraigned on May 5 charges in Vineyard Haven of drunken driving and negligent operation of motor vehicle. Pretrial hearing scheduled for June 23.

David M. Viera, 48, of Edgartown, arraigned on Sept. 25 charge in Oak Bluffs of breaking and entering for misdemeanor. According to police report, allegedly slept in someone’s car. Pretrial hearing scheduled for June 19.
