The following case was heard in Edgartown district court.

June 29

Joseph E. Peters, 44, of Oak Bluffs, was arraigned on June 27 charges in Oak Bluffs of a second offense of driving under the influence of drugs (Seroquel) and negligent opertion of a motor vehicle. Defendant entered pleas of not guilty. Defendant released on personal recognizance. Pretrial hearing scheduled for August 10.

June 30

Hannah Elias, 29, of West Tisbury, was arraigned on June 30 charges in Edgartown of speeding in a specially-regulated area, negligent operation of a motor vehicle and drunken driving. Defendant released on personal recognizance. Pretrial hearing held July 10. Defendant admitted to sufficient facts on charge of negligent operation of a motor vehicle. Defendant paid $250 OUI fee, $50 to OUI victims assessment, $50 to the victims and widows assessment and $250 to the head injury assessment. Defendant’s driver’s license taken away for 45 days and alien warning was given. Case continued without finding to July 8, 2024.

Alfred Porter, 26, of Oak Bluffs, was arraigned on June 30 charges in Oak Bluffs of failure to stop or yield, speeding at a rate exceeding the posted limit, drunken driving, possessing an open container of alcohol ina motor vehicle, and negligent operation of a motor vehicle. Defendant released on personal recognizance. Pretrial hearing scheduled for August 10.

July 3

Austin Desilva, 21, of Brewster, was arraigned on a July 1 charge in Edgartown of assault and battery. Defendant released on personal recognizance and payment of $150 counsel fee. Pretrial hearing scheduled for August 24.

Austin Desilva, 21, of Brewster, was arraigned on a July 1 charge in Oak Bluffs of vandalizing property. Defendant released on personal recognizance. Counsel fee waived. Pretrial hearing scheduled for August 24.

Flavio Desouza, 34, of Hanson, was arraigned on July 1 charges in Oak Bluffs of unlicensed operation of a motor vehicle and possessing an open container of alcohol. Charge of unlicensed operation of a motor vehicle dismissed on recommendation of the Probation Department. Defendant found not responsible on charge of possessing an open container of alcohol in a motor vehicle. Case closed.

David Figueroa, 34, of Portland, Me., was arraigned on a July 2 charge in Edgartown of assault and battery on a family or household member. Defendant released on personal recognizance and payment of $150 counsel fee. Pretrial hearing scheduled for August 24.

Ashleigh Harper, 29, of Vineyard Haven, was arraigned on July 3 charges in Oak Bluffs of assault and battery with a dangerous weapon and disorderly conduct. Defendant released on personal recognizance and with further condition to stay away from and have no contact with alleged victim. Pretrial hearing scheduled for August 24.

Barbara Hartmann, 48, of West Tisbury, was arraigned on a July 1 charge in Oak Bluffs of drunken driving. Defendant entered plea of not guilty. Defendant released on personal recognizance. Pretrial hearing scheduled for July 14.

Peter Shaw, 57, of Oak Bluffs, was arraigned on July 1 charges in Edgartown of drunken driving and negligent operation of a motor vehicle. Defendant released on personal recognizance. Pretrial hearing scheduled for August 24.

July 6

Max Bosman, 46, of Vineyard Haven, was arraigned on June 14 charges in Vineyard Haven of indecent assault and battery on a person age 14 or over, open and gross lewdness, intimidating a witness, juror, police or court official, and assault and battery. Defendant released on personal recognizance and with further condition to stay away from and have no contact with alleged victim, Pretrial hearing scheduled for August 25.

Cleybersen G. Defigueredo, 35, of Edgartown, was arraigned on July 4 charges in Edgartown of drunken driving, negligent operation of a motor vehicle, a marked lanes violation and unlicensed operation of a motor vehicle. Defendant released on personal recognizance and payment of $150 counsel fee. Pretrial hearing scheduled for August 25.

Daniel Raspante, 34, of Oak Bluffs, was arraigned on Dec. 26, 2022 charges in Vineyard Haven of trespassing and two charges of breaking and entering for the purpose of committing a misdemeanor. Defendant released on payment of $150 counsel fee, $150 bail and with further condition to stay away from address of alleged incident. Pretrial hearing scheduled for August 25.

Adam C. Smilgis, 42, of Vineyard Haven, was arraigned on March 21 charges in West Tisbury of breaking and entering a building during daytime for the purpose of committing a felony, larceny from a building, larceny by checking of more than $1,200, forgery of a check and uttering a false check. Defendant released on personal recognizance, payment of $150 counsel fee and with further conditions to stay away from and have no contact with alleged victim and the alleged victim’s address. Pretrial hearing scheduled for August 14.
