The spring sitting of Dukes County superior court opens this week with a mix of cases, including one civil case that pits an Edgartown property owner against the town historic district commission.

The Hon. Cornelius J. Moriarty 2nd will preside over the monthlong session, which is scheduled to end on April 29. As a first order of business, the court will empanel a new grand jury that will serve for the next six months. The grand jury will consider any new indictments today.

A civil bench trial is scheduled to begin Tuesday in a dispute over whether John Ettinger and Linda Simpson can demolish a home they own at 8 Pease’s Point Way in Edgartown. The home sits within the historic district.

A year and a half ago the town historic district commission denied an application for a permit to tear down the house and build a new structure. Mr. Ettinger and Ms. Simpson appealed the denial in superior court, claiming the decision was arbitrary and capricious and violates the town historic district bylaw.

Mr. Ettinger and Ms. Simpson named the commission and each individual member of the commission in the lawsuit.

They waived their right to a jury trial, opting to try the case before Judge Moriarty, who will hear the evidence and decide the verdict.

In pending matters on the criminal side, three men face drug charges following grand jury indictments issued earlier this year.

Jeffrey A. Sylvia, 27, is scheduled for arraignment on five separate drug charges, including heroin trafficking and heroin distribution. He was arrested in July 2015 after the Martha’s Vineyard Drug Task Force executed a search warrant on the home where he lived. Mr. Sylvia is also facing heroin trafficking charges in Boston and was arrested by Boston police on March 18 while still under indictment in the Vineyard case.

Also scheduled for arraignment are Desmond J. Roderiques, 24, and Aaron M. Watkins, 28, both of New Bedford. They are charged with heroin trafficking, cocaine trafficking and conspiracy to violate drug laws. The two men were arrested in October 2015 shortly after they drove off a Steamship Authority ferry in Vineyard Haven. After a search of the vehicle, police said they found drugs concealed in the engine compartment.
