PUBLIC NOTICE INVITATION TO BID WWTF ENHANCED NITROGEN
REMOVAL UPGRADE TOWN OF OAK BLUFFS, MA
CONTRACT NO. 2022-09 SRF NO. 7207
In accordance with M.G.L. c. 149, 44D½ and 44D¾, and 810 CMR 9.00 and 10.00, the Town of Oak Bluffs has established a two-phase process for the selection of General Contractors and filed sub-bid Subcontractors for the construction of the Wastewater Treatment Facility (WWTF) Enhanced Nitrogen Removal Upgrade for the Town of Oak Bluffs, MA. Only those contractors/subcontractors prequalified to bid on the above referenced project shall be invited to submit bids and/or sub-bids as part of Phase 2 of the selection process. Sealed bids for General Construction will be received by the Town of Oak Bluffs at the WWTF, 17 Pennsylvania Ave, Oak Bluffs, MA until 2:00PM local time on November 14, 2023, and at that place and time will be publicly opened and read aloud. All bids will be valid only when accompanied by a current certificate of eligibility and updated statement (Form CQ3) issued by the Division of Capital Asset Management and Maintenance (DCAMM), showing that the General Bidder has the classification of Sewage and Water Treatment Plants. Filed subcontractor sealed bids designated herein for construction of the above referenced project will be received by the Town of Oak Bluffs at the WWTF, 17 Pennsylvania Ave, Oak Bluffs, MA until 2:00PM local time on October 25, 2023, and at that place and time will be publicly opened and read aloud. All bids will be valid only when accompanied by a current certificate of eligibility and updated statement issued by the Division of Capital Asset Management and Maintenance (DCAMM), showing that the Filed Sub Bidders have the classification matching the Filed Sub-Bid being submitted. The Project is being bid under the provisions of M.G.L. c.149, s44D. Bidding and award of this Contract shall be required to comply with M.G.L. c.149, Section 44A-44J, and all other applicable MA General Laws. Separate sealed Bids will be received for the following: General Construction – Sewage and Water Treatment Plants; Masonry; Miscellaneous and Ornamental Iron; Roofing and Flashing; Painting; Heating, Ventilating, and Air Conditioning; Plumbing; Electrical. The Work consists of renovations and upgrades to the WWTF in accordance with the Bidding Documents heretofore prepared by GHD Inc. 935 calendar days will be allowed for contractor to achieve substantial completion and 995 calendar days to achieve final completion. GHD Inc. is the issuing office for this Project. Copies of Bidding Documents may be purchased at the office of GHD Inc. after 12:00PM on September 25, 2023. Bidding documents are available in both electronic and hardcopy form. Disadvantaged Business Enterprise (DBE) goals are applicable to the total dollars paid to the construction contract. The goals for this project are a minimum of 4.20 percent D/MBE participation and 4.50 percent D/WBE participation by certified DBEs. The two low bidders shall submit completed DBE forms (EEO-DEP-190C & EEO-DEP-191C and the DBE Certification of US Citizenship form) by the close of business on the third business day after Bid opening. Failure to comply with the requirements of this paragraph may be deemed to render a proposal non-responsive. No waiver of any provision of this section will be granted unless approved by MassDEP. Minimum Wage Rates as determined by the Executive Office of Labor and Workforce Development under the provision of the M.G.L., c 149, Sections 26 to 27D, as amended, apply to this project. It is the responsibility of the contractor, before bid opening, to request, if necessary, any additional information on Minimum Wage Rates for those trades people who may be employed for the proposed work under this contract. Federal Minimum Wage Rates as determined by the US Department of Labor under the Davis-Bacon Act also apply to this project. The Town of Oak Bluffs reserves the right to waive any informalities or to reject any or all Bids. Bidders are required to certify, under penalty of perjury, that Bids have been prepared without collusion with other Bidders, subcontractors, suppliers, etc. The Project is to be funded in part by the MA Water Pollution Abatement Trust (the “Trust”). The Project requires compliance with the DEP’s Diesel Retrofit Program. This project is funded by appropriations that contain “Build America, Buy America Act” (BABA) requirements. Note that the BABA requirements are waived for this Project based on EPA’s Decision Memorandum titled Adjustment Period Waiver of Section 70914(a) of P.L. 117-58, Build America, Buy America Act for SRF Projects that have Initiated Design Planning issued September 2, 2022. The Project is subject to the American Iron and Steel requirements of P.L. 113-76, the Consolidated Appropriations Act of 2014.
