Differences for the Former Cape Poge Little Neck Bomb Target Munitions Response Sites and Tisbury Great Pond Munitions

The U.S. Army Corps of Engineers (USACE) New England District, with the concurrence of the Commonwealth of Massachusetts Department of Environmental Protection (MADEP), is issuing an Explanation of Significant Differences (ESD) for the April 2015 Final Decision Document for the Former Cape Poge Little Neck Bomb Target Munitions Response Sites (Cape Poge MRSs) in Edgartown, Massachusetts, and the June 2016 Decision Document, Tisbury Great Pond (TGP MRS) in West Tisbury and Chilmark, Massachusetts. The ESDs are required by the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). ESDs provide updates to a selected remedy and its implementation, updates to MRSs boundaries, and/or other relevant clarifications on the Final Decision Documents.
Between 1944 and 1947, the Cape Poge MRSs were used for day and night practice bombing activities using water-filled bombs, miniature bombs and flares. Between 1943 and 1947, the TGP MRS was used as a practice bombing and strafing range. The selected remedy for both the Cape Poge and TGP MRSs was subsurface clearance and implementation of Land Use Controls (LUCs) until unlimited use/unrestricted exposure (UU/UE) was achieved. The TGP remedy was completed in 2021, and the Cape Poge remedy was completed in 2019. After the remedies were completed, a site review was undertaken to determine if the selected remedy was protective of the community and environment. Based on the depth of munitions found during clearance activities and the continued discovery of munitions in the MRSs, it was determined that UU/UE was not achieved at either Cape Poge or TGP MRSs. Therefore, an ESD was prepared for each MRS to update the selected remedy to include continued implementation of LUCs. The LUCs include: maintenance and posting of educational signage, coordination with land owners, annual 3Rs Explosives Safety Education program training for land owners and town staff, as well as Five Year Reviews to evaluate if the LUCs are protective of human health and the environment.
