Two West Tisbury property owners have agreed to pay $6,760 in fines for violating the state Wetlands Protection Act.

Stephen Rattner and Maureen White, who own property on Obed Daggett Road, were cited by the state Department of Environmental Protection for cutting violations in a vegetated wetland on the North Shore. The DEP issued a press release about the penalties this week.

In 2001 and 2002 the Rattners filed notices of intent with the West Tisbury conservation commission requesting permission to cut and clear brush and trees in an area designated as the buffer zone for a bordering vegetated wetland. The request was denied and the Rattners appealed to the DEP, which issued superseding orders that allowed the cutting with conditions.

A site inspection conducted by the DEP in August of 2007 found the conditions had been violated.

“The vitality of bordering vegetated wetland is a matter of public concern. . . We need to respect and protect this natural resource,” said David Johnston, acting director of the DEP Lakeville office, in the press release.

“This was an inadvertent cutting of wetlands and we have taken steps to make sure it doesn’t happen again, and we regret the errors,” said Michael Vhay, a partner with DLA Piper in Boston who represents the Rattners.
