Edgartown attorney Edward W. (Peter) Vincent Jr. appeared in district court this morning on charges of larceny by embezzlement over $250 and fiduciary embezzlement. His arraignment on criminal charges was postponed until May 19, after his attorney, Richard, Piazza, this morning cited an agreement on the continuance with the attorney general.

Mr. Vincent’s wife and daughter attended the hearing before the Hon. Herman J. Smith.

Mr. Vincent was arrested by Edgartown police on Friday afternoon at his South Water street home. By Friday evening, a bail commissioner released Mr. Vincent on personal recognizance after he surrendered his passport.

A case alleging Mr. Vincent misused client funds is due for hearing this afternoon in Suffolk Superior Court. A judge in that case, brought by First American Title Insurance Company, froze Mr. Vincent’s bank accounts, placed liens of $500,000 against his property and income, and provided First American access to legal files in his office dating back to 2005.

The criminal charges stem from a second case, filed in Dukes County Superior Court in mid March by the MSPCA, also alleging misuse of funds, which has resulted in liens of $200,000 against Mr. Vincent’s real estate and a separate hold on his bank accounts.

Mr. Vincent’s attorney in those cases, Roger Matthews of Boston firm Denner Pellegrino, last week told the Gazette that his client expected to have the funds by early this week to make restitution to both First American and the MSPCA.
