Edgartown selectmen voted to impose a permanent restraint order for a dog involved in an incident outside a home on Hye Way in December.

The action came following a dangerous dog hearing at the weekly selectmen’s meeting Tuesday.

The complaint was filed by Luiz DeMiranda, who lives on the property at 2 Hye Way. He told animal control officers that a pit bull owned by his neighbor bit him on the elbow. The investigating officer later observed the bite was deep enough to draw blood, and Mr. DeMiranda received treatment at the Martha’s Vineyard Hospital, according to the animal control officer’s report.

Mr. DeMiranda did not attend the hearing.

Brian Scott owns the dog, named Jaxx, and lives in a different house on the same property. He told selectmen his dog is not aggressive but does jump toward people when he gets excited.

Animal control officer Barbara Prada said she quarantined the dog for 10 days, and observed no aggressive behavior toward people or other dogs. She also described Mr. Scott as a responsible dog owner.

“Due to Mr. DeMiranda’s statement that he just wants Mr. Scott to be more careful with his dog, I am recommending that the board of selectmen rule Mr. Scott’s dog as a nuisance dog,” Ms. Prada wrote in her report. She also recommended that the selectmen require Jaxx to be leashed at all times.

Selectmen Margaret Serpa and Arthur Smadbeck voted to impose the order. Selectman Michael Donaroma did not attend the meeting.
