Dirt biking at Nip ’n Tuck farm does not rise to the level of a public nuisance, West Tisbury zoning inspector Ernie Mendenhall said at Wednesday’s meeting of the West Tisbury selectmen.
“I wrestled with this one,” Mr. Mendehall told the board. “I think dirt bikes really can be a nuisance. I’ve been back and forth with the bylaws and went over there to listen and in my opinion it’s a residential accessory use.”
The opinion was sought by the selectmen following complaints from neighbors about noise from weekend dirt bike riders at the landmark former dairy farm off State Road.
Mr. Mendenhall acknowledged that his decision may be unpopular, but he said that if the noise bylaws were strictly adhered to lawn mowers could be hypothetically prohibited.
Wayne Greenwell of Yellow Brick Road, one of the unhappy neighbors who had complained to the selectmen, reacted with chagrin.
“You guys work with these bylaws on a regular basis, what we would like to know is what are we missing?” he said. “We have a nuisance to the neighborhood. Why is [the town noise bylaw] not enforceable?”
Selectman Richard Knabel told Mr. Greenwell that he can appeal the ruling before the West Tisbury zoning board of appeals.
