A Dukes County grand jury handed down indictments Monday for two men on rape charges.

Adam M. Smith of Berkeley, Calif., was indicted on three counts of rape and one count of intimidating a witness/juror/police/court official.

He was arrested and arraigned in September; the Cape and Islands assistant district attorney Amanda Chaves said at the time that Mr. Smith was on the Vineyard for a bachelor party, and a woman and two of her friends agreed to return to a rental home where Mr. Smith and his friends were staying after a night out in downtown Edgartown. Citing the police report, Ms. Chaves told the court the woman went upstairs with Mr. Smith, became uncomfortable in the situation and tried to leave, and was held down and raped.

She said Mr. Smith, who was 27 at the time, allegedly threatened to kill the woman with a gun.

After the arraignment in district court, the Hon. J. Thomas Kirkman set bail at $25,000.

Michael L. Jackson, 47, of Edgartown, was indicted on two counts of rape; the offenses allegedly took place on June 7 in Edgartown. Mr. Jackson was arraigned June 8 in Edgartown district court and bail was set at $5,000 along with conditions. The police report was impounded and there were no details in the court file.

Mr. Jackson and Mr. Smith are both scheduled to be arraigned in superior court on April 15.

The indictments were handed down by a new grand jury that convened Monday as the spring sitting of the superior court got underway. The Hon. Cornelius J. Moriarty 2nd is presiding over the session.

On Tuesday morning a civil trial began involving the Edgartown historic district commission and two Edgartown property owners. A year and a half ago the commission denied an application by John Ettinger and Linda Simpson to demolish a home they own at 8 Pease’s Point Way. Mr. Ettinger and Ms. Simpson are appealing the decision.

The bench trial was slated to continue on Wednesday.
