As promised, the Wampanoag Tribe of Gay Head (Aquinnah) is appealing a ruling that it has no legal authority to run a gambling facility on the Island. The tribe’s lawyers filed the one-paragraph notice of appeal on Feb. 1, which moves the case to the U.S. Court of Appeals for the 1st Circuit. In November, U.S. District Judge F. Dennis Saylor 4th ruled that the tribe had no authority to open an electronic bingo facility in its vacant community center over the wishes of the state and town. While the appeal proceeds, the tribe plans to finish work on the building and use it as a community center, according to a vote by tribal leaders last month.
