A woman who says she was injured when a man allegedly drove drunk in a pedestrian-only part of the Oak Bluffs Camp Ground is now suing the driver.
Lorna Welch filed a complaint in Dukes County Superior Court last week asking a judge to order David C. Murphy to pay for her medical care for injuries she suffered when he allegedly drove his car through the Camp Ground.
Ms. Welch lives in the Wesleyan Grove neighborhood where Mr. Murphy was arrested on Sept. 9. Police say Mr. Murphy was inebriated when he ran over a “no vehicles allowed” and then hit several cottages.
In her two-page claim, Ms. Welch said she was walking on Wesleyan Grove when Mr. Murphy came crashing into the neighborhood. She had to run out of the way to avoid being struck by Mr. Murphy, resulting in torn ligaments in her knee, according to the suit.
Hospital expenses, according to court documents, have been over $50,000.
“Ms. Welch was walking down a pedestrian street, in an area that was supposed to be safe and off limits to vehicles, when she was forced off the walkway," her attorney Luke Mitcheson said. "Being almost mowed down by a drunk driver caused Ms. Welch to suffer severe injuries. We are fighting on behalf of our client to hold this driver accountable for his alleged recklessness.”
Mr. Murphy is now facing charges of a third offense of operating under the influence, leaving the scene of a property damage accident, negligent operation of a motor vehicle and four counts of malicious destruction of property.
He pleaded not guilty in Edgartown District Court in September and has a court date later in October.
